The BenefitsUsage Platform

BenefitsUsage provides an online platform that connects service providers with individuals or businesses seeking such services. BenefitsUsage is not a provider of any of the services offered through our platform, nor is BenefitsUsage an agent or employer of any service provider.

Account Registration

To access certain features of the platform, you must register for an account. You must provide accurate, current, and complete information during the registration process and keep your account information up-to-date at all times.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify BenefitsUsage immediately if you suspect any unauthorized use of your account or access to your password.

Service Provider Terms

If you register as a service provider, you understand and agree that:

• You are responsible for the quality, safety, and legality of the services you provide
• You must maintain accurate and up-to-date information about your services, qualifications, and availability
• You must comply with all applicable laws, regulations, and industry standards
• You are responsible for obtaining any necessary licenses, permits, or certifications
• You must maintain appropriate insurance coverage for the services you provide
• You agree to BenefitsUsage's service fee structure as outlined in the Fee Schedule

Client Terms

If you register as a client seeking services, you understand and agree that:

• You are responsible for providing accurate information about your service needs
• You must communicate clearly with service providers about expectations and requirements
• You are responsible for paying for services in accordance with the agreed-upon terms
• You must provide a safe and appropriate environment for service providers to perform their services
• You agree to BenefitsUsage's service fee structure as outlined in the Fee Schedule

Payments and Fees

BenefitsUsage charges service fees for the use of our platform. These fees are detailed in our Fee Schedule, which is incorporated by reference into these Terms. We reserve the right to change our fees at any time upon notice to you.

All payments must be made through the BenefitsUsage platform. Attempts to circumvent our payment system are prohibited and may result in termination of your account.

Reviews and Ratings

Users may leave reviews and ratings for service providers. Reviews must be honest, accurate, and based on personal experience. Fake reviews, harassment, or attempts to manipulate the review system are prohibited.

Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Violating any applicable law, regulation, or third-party rights
• Providing false, inaccurate, or misleading information
• Using the platform for any illegal or unauthorized purpose
• Attempting to circumvent the BenefitsUsage payment system
• Harassing, threatening, or intimidating other users
• Posting discriminatory or offensive content
• Attempting to manipulate reviews or ratings
• Scraping, data mining, or otherwise collecting data from the platform
• Introducing viruses, malware, or other harmful code
• Interfering with the proper functioning of the platform

Termination

BenefitsUsage reserves the right to terminate or suspend your account and access to the platform at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, BenefitsUsage, or third parties, or for any other reason at our sole discretion.

Intellectual Property

The BenefitsUsage platform and all content, features, and functionality thereof are owned by BenefitsUsage, its licensors, or other providers and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Disclaimer of Warranties

THE BENEFITSUSAGE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. BENEFITSUSAGE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

IN NO EVENT SHALL BENEFITSUSAGE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE PLATFORM.

Indemnification

You agree to indemnify, defend, and hold harmless BenefitsUsage and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to your violation of these Terms or your use of the platform.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Changes to Terms

We may modify these Terms at any time. If we make material changes, we will notify you by email or through a notice on our platform prior to the change becoming effective. Your continued use of the platform after such notification constitutes your acceptance of the modified Terms.
